Sony does not own it once the sell it to you. You only agree to terms of service if you use their network. They can not legally stop you if you beat it with a sledge hammer. Piracy is one thing but actually destroying your consumer experience because of something you might do or haven't done is wrong on so many levels.
No one said kinect was better than move. The whole arguement was about which would sell more. And no matter what you think the majority of people out there are totally ignorant about gaming. Their choices will be determined by marketing not by being informed.

The one question at the heart of all of this though is one that gets glossed over with the piracy issue. When you buy digital media do you really own it? Can you transfer it? Do you own your console? Or just the right to use it? If the answer to any of these questions is no, then we are being seriously ripped off on the price we pay for games and consoles. Of course they are working on PS4, but to release it in 2012 before the PS3 even reaches a $200 price point is dumb. They just started making a profit on the thing.Why would they want to split their market like they did this generation. They haven't even made their development costs back much less the money they loss selling the PS3 at less than it cost them to build. No SONY want profits not losses and 2012 means they will lose money.
Sony first party developers have been around for a long time. very talented. and most games for the 360 use unreal engine. Seriously MS just fell behind on showing off power of 360 with all that third party development crap. Small first party studios equal getting your butt handed to you on console specific games.

MS purchased 3DV but they are using Primesense' tech so it isn't the same tech that Nintendo was shown. According to the article PrimeSense is even providing the chips for Kinect.
Sony and MS are taking the long term view. When the next generation launches Nintendo will not have a unique feature which will allow them to run away with the market. At that point it will be based on games people want to play. And in this new market Nintendo is woefully behind in shooters and RPG's. There is no way they can catch Nintendo, but it will never happen again with move and Kinect being apart of the more hardcore systems.

At this stage in the console cycle developers are getting to know the big three's machines fairly well. A new machine would raise the price of development again. But there are a ton of shooters out there and unless you have to pay to play all of them, putting a price on CoD will just be a barrier to playing the game. When will these people get it through their heads the economy has changed. Our money is held closer these days. We need more value for our dollar since we worked for it.
