Microsoft and THQ Don't Understand the Word "Free"

Loot Ninja writes:

"While browsing the Xbox Live Marketplace today, I came upon a new item for UFC 2009 Undisputed which offers two new fighters, Ryan Bader and Efrain Escudero. What struck me as odd is the description accompanying the DLC. As you can see in the above picture, this item costs 320 Microsoft Points. However, the description states "Download these free roster additions…" Did I miss something here?"

Pre-order bonus should not be labelled as "Free". That misleads to think Free for everyone. I hate when stuff is hidden in the fine print.

Whether you pre-ordered or not you still payed for the game. The people who pre-ordered didn't pay any extra for the content so why should you?

The bonuses that you get for pre-ordering should either be exclusive to those that pre-ordered or made free some time later on. No one should have to pay if the first set didn't. I do ont like this train of thought they seem to be in.

Does anyone know of any other times when a pre-order download-able bonus became purchase-able content later on? If it was something physical that's fine but digital content? How sad.

As I stated in a comment above, I, the author, knew they were preorder bonuses. That does not change the fact that these are currently labeled as both 320 Microsoft Points and FREE on the Xbox Live Marketplace.

no it just shows that you are making a big deal of nothing

it is a mislabel, a description that hasn't been updated

rational people see it as that but you are trying to make some big to do out of it

browse the marketplace, there are typos, mislabels, wrong descriptions scattered throughout, write an article about something that matters instead of just writing something to pull hits

...don't be surprised to see MS fanboys justify this. And I'm not saying anyone that has a 360 is a fanboy, just those who can justify this, RROD, E74, charging to play online, needing paid subcription for things that are already free like Twitter and Facebook, etc., etc.

actually, it is the responsibility of the devs and microsoft to make it clear in every possible way that it is either free or costs 320 points, not both. someone could make the claim that the product's pricing is misleading and get the content for free because they could have initially been drawn to the content because they THOUGHT it was free. these kinds of typos can easily be used as legal loopholes if necessary.

it's just like in a grocery store. if an item is advertised at a specific price in either a flyer, or the sticker price, and yet is rung up to being more than what is advertised before taxes, the customer is entitled to having that item for free as long as the difference is under $10.

in effect, microsoft and THQ made a boo boo that smart people can capitalize on. but then again, who'd want too for just two fighters?

@outlawlife - False or misleading advertising is illegal. If you are selling products you must represent them accurately. In retail stores (brick & mortar) if you mislabel a price the customer receives the item at the lower price.

PSN offers them for free but MS doesn't want you to have that which makes sense. You see why their system are so closed and that UT3 is one of the reasons why it didn't go so well with MS. Or even the idea of LBP for the 360. One part of free means they gotta charge you.

nickle and dimeing like how you can spend more on additions for LBP than you bought the whole game for... stuff in Home is no different than how Live is with Avatar pricing only Home can go a step further with furnature, etc.. Killzone 2 mappacks, and the list goes on and on and on.

If you walked into a store and you found a rack labeled free. Took the stuff to the register and found out you had to pay for it then you would be a bit upset as well. Now to add to the anger you walk to a store next door and find the same item labeled free and in this the store they do give it to you for free then you would be very confused by what was going on at the first store. Would you not?

Now to be fair our market allows for various stores to have different prices. That is well and good. But it does not mean that people can't be angry when one store is charging for something that another is giving away.
