Interplay countersues Bethesda over Fallout rights

An Interplay stockholder details the countersuit filed by Interplay against Bethesda in reaction to Bethesda's lawsuit over the rights to Fallout Online and the original Fallout games. Interplay argues Bethesda is in breach of contract abd the contract to sell the rights to the series to Bethesda is null and void and Interplay owns the franchise again.

Wow that is an interesting read. I can't believe how greedy Bethesda is if this is true. I also think if Interplay can make new Fallout games after Fallout 5 from Bethesda then that too is interesting. I really think if this is true then Bethesda shot them selves in the foot. Because Interplay now will know people will want a game like Bethesda made and will make one like that. But if I am really lucky one that is the top down view. That I want to see. So this will be an interesting battle if this goes to court.

I hope Interplay wins after reading this I was shock to see the underhanded moves Bethesda were using to mess with the sells of fallout 1&2&B.

LMAO, I thought the same thing when I read his remark also.

Talk about the pot calling the kettle black. People just never learn that if you're going to insult someone about their intelligence, they should first make sure they are intelligent enough to pull it off. Plus either way they just end up looking like an A**hole.

Interplay needs to get some cash first, buy their games on Good Old Games, support the cause!

The Fallout franchise returning to Interplay would be amazing, I've been playing he first two games recently and I am amazed. Fallout 3 was good but it felt too much like Oblivion to me, infact, it wasn't even as indepth as Oblivion!

Plus, Fallout 2 letting you be a pornstar = hilarious!

LOL! You got to be a pornstar in Fallout 2? I just ended up as a fluffer.

I knew I should've picked that Sex Appeal perk!

Bethesda was "out lawyered" by Interplay.

Good for Interplay and their legal representation.

Anybody know the law firms involved?

I'd be rooting for interplay normally, but I remember now that the company is headed by Herve Caen now. So anyone who actually cares about Fallout is long gone.

I want Van Buren as a Fallout 3 expansion or just running of an improved Fallout 3 engine.

That'd be sweet.

Not everyone. Chris Taylor, lead designer of Fallout 1, is still at Interplay.

Van Buren wouldn't work as a Fallout 3 expansion. First, I'd prefer it to use the original gameplay style. Second, it would need map travel like in the originals, since it spanned the entire four states and wasn't a compressed version of one city and its surroundings like Bethesda's FO3.

There is also a little know studio out there called "Obsidian Entertainment" which employees and was created by a majority of the ex Black Isle staff.

I still remember the first time I saw Fallout 1 on the shelf at Future Shop.

On the back it said, "Remember Wasteland?"

And I said, "Remember it, I still play it!"

The guys at Interplay became my heroes that day.

Does anyone know of another source for this information? As the article seems a tad bias in this matter.

I'm hoping Bethesda keeps the rights to the Fallout universe as they outsourced the next game to Obsidian.

Bethesda should keep making standart Fallout games while Interplay should concentrate on making a great Fallout MMO. I personally liked Fallout 3. Sure it's not like Fallout or Fallout 2 but it's still a Fallout and it's still a great game. Bethesda may learn the mistakes (which isn't much) they made at Fallout 3 to make a perfect game. That suing each other thing not exactly what we want...

The article was written by a child and is extremely bias, no excerpts from the documents, just his paraphrasing.

I find it hard to believe. I read info about the contract before fallout 3 was released. It was reported that they didn't have the money by the due date ( and if bethesda did cancel it even though they did, we would have heard from it back in april, instead they made it seem true)

I think Bethesda's underhanded actions are deserving of a true pwning by Interplay, but I don't want Bethesda to lose that $15-20 million either :S

I see that money as going towards the development of the next Fallout or Elder Scrolls game, and I would much rather get one of them from Bethesda before I'd want to see a title from Interplay.

How does Fallout: New Vegas work into this? Would this be considered Bethesda's Fallout 4?
Shut this user up Let user speak

Yea, Fallout New Vegas would be considered Fallout 4. Therefore, if Interplay wins, New Vegas could have a different name and become a new IP.

The funny thing is, I remember reading that the only reason Interplay could even "reopen" their doors was buy selling the Fallout rights to Bethesda. Otherwise they would have gone bust and wouldn't even be in a position to make games let alone pay to keep the lights on. The article (can't seem to find it) even made it seem as though Bethesda basically gave Interplay a chance to still develop the Fallout MMO.

We all know Bethesda did everything for money (who doesn't do everything for the money?), but it seemed as though they were basically throwing Interplay a bone. Maybe the story was wrong or I have a bad memory. Either way, this situation isn't what I wanted to hear. I want Fallout games to be released, not embroiled in court rooms or hung up with f'ing lawyers. Hope this gets resolved one way or another and soon.

Bethesda sued Interplay first because they essentially wanted full control of the Fallout franchise. Interplay countered by launching a suit of their own because they claim to have a valid case.

Um this article has it wrong completely. Bethesda sued because Interplay sold a product called "Fallout Trilogy" (a compilation of 1,2, and Tactics) which they never had the right to sell because its misleading to the consumer. You think you are getting FO3 in the bundle. Interplay's games suck, it was Black Isle who was great and most of them including the original Fallout team have moved on to better places. Interplay just wants a bigger piece of the Fallout 3 pie because Bethesda made such a superior game to there old bug ridden fourteen generations ago game (the only people that even bought it are 40 year olds who played the originals and people who thought it would be like fallout 3). I'm sorry but FO1 and FO2 are NOTHING compared to FO3 and we have BethSoft to thank for that. Interplay's newest games are all remakes anyway, we haven't even seen them venture into HD for gods sake. Interplay will just ruin everything, I can't believe they would take the rights from Obsidian and Bethsoft (even though Obsidian compromises most of the original Fallout team including the original script writer.)

In my view, the perfect outcome of this would be for Bethesda to be stripped of the rights to the franchise (retaining Fallout 3, of course). I don't know if Interplay is capable anymore of making a good Fallout game, but I do know that Bethesda sure isn't.
