the creator gave out the source code for people to learn, he should have got a copyrights protection from person/company financial benefit from the his codes..

but also wrong other company to do that... but this is a free market.. you don't protect your works someone will steal and benefiting from it..

I'm going to have to try this iPhone game out. I could see this ending in a cease and desist order if anything. The creators can try to pursue it further but even if they wrote the game from scratch, the similarity, more specifically the assets are just undeniable.

Wow, response of them is really douchy:

"Actually, all the source code is completely, 100% written from scratch. Please check your facts before you make such baseless accusations."

And they totally miss the point, it might be ok to copy off gameplay, a lot of good games have done this.

But if they're simply to dumb to come up with their own visual style and make it exactly the same game alltogether, they deserve nothing less then to get their sh*t sued out of them.

the App store has been updated to read "Aquatica is an iPhone from-the-ground-up re-make of the famous flOw game created by Jenova Chen of ThatGameCompany." The article says the game is free but it is $1.99. Reviewers wrote "complete ripoff", while others are praising it. Oh those uninformed..

This article is a bit outdated, there have been a few developments since then. No word from Sony yet, I doubt these guys would be able to pay the legal fees either. Then again, they could have used the concept but the least they could have done was change the assets up! Doesn't the Spore iPhone game have a similar concept behind it? See, a simple skin change and they would have been ok.

It now gives the game flOw and it's creators credit + it's free. I downloaded it and don't really see the problem. they're not claiming for someone else's work and not making a profit. They're just allowing you to play 'flow' on the iphone.
