LittleBigPlanet getting moderated without warning: So much for creative freedom

If you're a big fan of user levels in LittleBigPlanet, the advice of the day seems to be this -- don't get too attached to them. Reports have been coming in of levels being "moderated" without warning. That's a polite way of saying they're getting deleted, and users are not being given the courtesy of an explanation.

some levels like levels with genitals etc need moderating and I agree they bloody well should be my kids play this game there should be minimum moderation as for making a level dedicated to another game there really is no law against that as you are creating stuff yourself from scratch. You are not actually taking anything from the IP and porting over so its allowed e.g. music which is why picture upload is disabled right now...

I don't get it. To me, this is on the same lines as amateurly remixing a game's music.. As long as you're not making a profit off of it, there's really no big deal. I really don't see where the copyright issues come into play in creating levels.
Nobody is making a profit off of these levels yet. As they said, maybe good user levels will be eligible for profit sometime down the line, but they could easily just make the levels with copyright material ineligible for that program.
This is pretty epic fail IMO. It's a shame creative freedom is being hindered by this crap.

There's an explanation why.
It's the Grief Report. Some random jack@ss just goes around and reports anything vaguely illegal in LBP. They see a great copyright infringed level? They report it for just that. The mods have to do something because someone complained about it, allowing the possibility of a lawsuit by some angry soccer mom who is mad that her children are playing "bad" things.

I know a fair share of people including myself who have had their levels moderated for no reason, no offensive materials of any kind and no mention of any Copyrighted-Material WHATSOEVER. It seems completely ridiculous that we are getting our levels deleted for no reason with no warning even after I checked the EULA I couldn't find anything that I have broken.

I've been a member of several digital art communities over the last 15 years or so and have been through this process many times.
It's funny how the same lame arguments come up every single time (See Open Zone for an example).

Same deal anywhere else. It's called moderation, not censorship. I fully expected it - we were certainly warned about it. It's part of the tutorial when they explain about what's acceptable. At no point was there any indication that you had completely free reign to do as you pleased...there were and are limits. If offenders still remain it's because there's a huge backlog of submissions, and it takes time to deal with them. Use the grief button if you've an issue.
Just keep your fan-levels on your Moon and submit the ones that don't violate international copyright laws. Have fun and quit whining.

2.2 - Trade marks and copyrights?
I can understand trademarks but copyrights are for content that are copied from the original. There is no code being copied the levels aren't being replicas. If I design movie about space that has laser swords in it I'm not stealing Star Wars copyrights.
It's simple if the content being produced is 100% user generated not using original content it's not stealing someones work. If I drew an image to look like an PS3 or picture of Ronald McDonald as long as that image was my original artwork, not a modified original from copyrighted content there is no patent on that image.
As for themed content, If the level design isn't a copycat of existing levels then I don't see it as infringing.
I Think MM just decided to avoid legal issues to just delete anything and everything so no disputes could be taken to court. This way instead of a big companies filing lawsuits MM would remove content entirely avoiding the problem. It's not that the content is truly illegal it's just an easy solution avoid any cases being brought up.

I can tell you've never had to deal with any of these concepts much.
Copyright is what you have over your own work; for example, a drawing.
If someone takes your drawing and stickers it all over their LBP level without your permission it's a violation of that copyright.

The point is that the scope of the "high level of moderation" also affects games on Sony's own platform. What's the point of buying LBP if you can't recreate your favorite things like MGS, GoW, Fable, Mirror's Edge, R2 and other stuff? It's practically cutting half of the reasons to buy LBP. Sure people can be original, but I know I would've loved to remake MGS4 for LBP however I don't want my work to be deleted just because some hornball's gonna pop a vein. Then you have the addition of idiots who report blatantly without giving much of a reason. Spamming the report system is clearly a flaw in LBP that must be addressed.
For starters, for users that abuse their reporting powers will have their privileges completely revoked.

There could actually be TWO possibilities to this whole thing:
1. What Destructoid said, which is very possible, and sad to see happen.
2. Some person (or group of people) are flagging these levels and MM isn't even checking into the actual reasons for it before pulling the trigger. This is similar to what was going on on YouTube for the same thing: Someone flagged a video for copyrights or whatever, and YT didn't even TRY to investigate and took whoever was flagging it as the truth and just pulling the video based on heresay alone.
Either way, people should be notified as to what is going on here, but I'm wondering if it's MM's decision based on their morals and fears, or just a bunch of people who have an ax to grind and flagging all of these to moderate all of these levels.
By the way, I've seen many levels that COULD be modded for this reason stay on for all this time without any incident. This makes me think this is more of the second thing happening.
@TheExodus: There is also fair use and how much of a fine line there is between what you can and can't do with that kind of content. You CAN make a spoof or a parody of a part of something that is copyrighted without getting permission (even though there is that moral high-ground that you SHOULD ask, by law, you don't HAVE to. Weird Al could never have any permission to do any of his parodies and still not break any laws at all under the fair-use doctrine). This could be akin to THAT, which makes the copyright thing a non-issue to begin with.

Actually I think simply theming a level around something qualifies as fair use. The issue may be that the levels are available globally, however, if the copyright is a US one for example then I think it falls under US law and thus constitutes fair use.
The amount of content in a themed level is often minimal, with only a picture or an attempt at recreation of something. Furthermore, the effect the level in question will have is very small for most levels which will not be played my many people. Also, the level itself is transformative, rather than derivative as described in the Wikipedia article.
It's possible something could be taken to court, and MM don't want to risk this. But I severlely doubt anything would become of it and they are playing it too safe.

so the master chief mod in UT3 was allowed due to "the creator not profiting from the mod" but the free-to-play levels in LBP are suddenly copyright infringement??

....but the games "unique look and physics engine", prevents users from creating "actual accurate representations" of real games or characters.
Seems like an over reaction to me on MM's part. Will SEGA lose any money if someone creates a "original" sonic level (with a blue sackboy mind you, not even a hedgehog) and puts it on PSN for free? Did sega lose anything? If anything it is free advertisement for a product and should be seen as such. Now if someone were profiting from such content, that is another issue.
At least wait until someone is offended before destroying peoples hard work.

I have a question, not that its my wish, but this could be done maybe:
get a seperate world/planet online for 18+ levels that's locked by a family lock in the PS3. That way the levels that are moderated in the normal online world/plant are not deleted, but just shifted through for those that like to play them.
Media Molecule, just an idea...
if not, can't a level be put on a memory stick, taken off the PS3, uploaded to a website where one can download, put local on your PS3 but still be able to connect with others to play that level through PSN co-op?

There mostly moderated because of copyright infringement. Being over 18 wouldn't make a difference. For the more mature levels, LBP is a kids game. Making an over 18 section defeats the point of it's mass appeal.

I'm pretty much tired of this game anyways. Getting online to play user created levels is a bit*h due to the servers hardly ever working and the main story levels are mediocre at best. This should have been a budget title. It wasn't worth 59.99 + tax. Thank god for Resistance 2.

It explicitly states in the EULA that they have the right to do that and that you are advised not to create things that infringe copyrights – ie 'god of war' and 'pplaystation 3' are a registered trademarks.
They're just covering they're asses. No need to cry about it. I don't think youtube got this much attention when it finally started moderating some of it's content a little.
