Actually, the judge has stopped the FTC from asking what is already known.

The restrictions to the order are for the FTC, not for Microsoft.

Which is a shame as they are not allowed to see all the requested documentation, trying to build a case when you can't see all the evidence is a kick in the teeth... but hey, the unimaginably wealthy just got way wealthier so evidence be dammed, champagne!!!

I will remain a fanboy of anyone that wants to protect the consumer from the market consolidation of companies like MS, even if the FTC is powerless or not. They couldn't stop the consolidation of the food market, airlines, ISP's, energy market, etc now the US is in a rut of low wages and high costs because they are powerless without institutional support.

The waste of time excuse is just that an excuse, the same when it comes to cost. Having access to the evidence you require for a case to prove links and trails and intent... also what you find funny is a little odd, the denial of evidence is "hilarious"?

But hey Abriael, market consolidation has won, gamers are losing access to games and one company is free to buy and dictate where the industry goes, be happy as your dream is coming true.

The "harm" is that a regulator isn't allowed to harass private companies by asking for a limitless mountain of documents and testimonies with no restrictions, which the judge himself then has to read and study, wasting his time as well.

Demands for lots of redundant documents and testimonies don't just waste Microsoft's money. It wastes the judge's time, which is literally taxpayer money.

Because it costs taxpayer money. The FTC already had 5 months of discovery and failed to prove anything. They don't just get to request however many documents they want to now. The judge is preventing them from wasting time, that's why they also can't request anything that includes information the FTC already has from other documents.

Everyone saying "wasting tax payers money" wont care 99% what happens to their tax money, but now when its your console maker it matters :D Let's not ever sue any big companies about anything, because it's a waste of money. Let's just get rid of FTC, problem solved. :)

Technically (and I do mean technically), "Too late" is never really a thing with US companies. Companies can be broken up via antitrust law.

Will it happen? Nah. Tech companies are pretty much allowed to do whatever they want. There's a failure to properly reprimand crypto bros and they've been talking about dealing with Google for years.

It can be be done. That is literally always an option.

But it won't be. American society can continue to deteriorate, but as long as representatives have money and protection from the masses, they don't care.

So in practice, you're right: it's too late. In principle, with a functional legislature (ha!) tech companies can be broken up.

This might affect future big acquisitions. Basically they're keeping an eye on Microsoft future acquisitions. I don't know if it would make any difference though

Hypercharge Unboxed Dev Saddened By Claims It'll Be 'Dead' Without Xbox Game Pass

One of the big Xbox releases heading our way in May 2024 is the long-awaited Hypercharge Unboxed, which is finally bringing its "first and third-person shooter action figure game" to Xbox consoles on Friday, May 31st.

Sadly, ahead of launch, the game's official Twitter (or "X") account has been highlighting the "trolls" who are claiming that because it's not launching on Game Pass, Hypercharge Unboxed is already set up for failure on Xbox.

It's horrible what people will say, but the truth might be harsh. There is a good chance it might not do well on Xbox if it's not on GamePass. There is a strong possibility that is the case. We'll see.

When it launches on Playstation in the future you can rest assured it will sell much better. The devs have confirmed it's coming to Playstation in the future.

"It is built in the Unreal Engine 4. The game was released on the Nintendo eShop on January 31, 2020 and on Steam on April 27, 2020. The development of Hypercharge: Unboxed for the Xbox platform was officially announced on July 16, 2022, with the developers also confirming future support for the PlayStation."

Unfortunately once people are conditioned to expect to get something as part of a subscription they already pay for, they are unlikely to buy it a la carte. Some games, including this one, now look like "Gamepass Games" to a huge chunk of the Xbox audience. Maybe this game will buck that trend, and I wish them luck, but I'd imagine they'll have a rough go trying to sell this game on Xbox.

It might be cheaper to simply pay the fine. Fighting said fine could cost millions due to court and lawyer fees. Fortnite generates well over a 100 million in each month, so Epic has plenty of cash.

But if they did pay it, then they are basically admitting that they did something they weren’t supposed to be doing. If they fight it, they may win and continue to have a sense of urgency for their micro transactions thus making more money long term.

Not a fan of Epic nor fortnite and their micro transactions. But the game is heavily supported and is free to play, all store items are completely cosmetic.

I mean it always start like this. Ubuntu was the same, started with just being able to load the GUI, now people can play classic PC titles like Fable and Warcraft 3 as well as emulate GC, Wii, 3DS and PS2 on their Switch. With Windows things are definitely harder because Windows on Arm is pretty garbo, but who knows in a couple of years.
