For those wanting a way around this, it depends on how large the patch is. Delete the patch from your system and don't download it. You're not required to download any patches unless you use the online portion of a game anyways and that's where the size of the patch comes in, if you decide you want to play online, repatch it, want to play offline, delete the patch again.
It's not ideal, but it's a way around it. Or I'd think it's a way around it. If 2K doesn't let the save file work without the new patch after you've already saved with it then you're forced to keep the update.
We decided not to fight the crowds this year and use the FlatGadget website to find some deals on consumer electronics. We will shop Green Monday the same way.
