This isn't a major victory. They're essentially being allowed to call witnesses in regards to agreements they reached with Sony and Ubisoft which was initially blocked because Microsoft didn't make the request through the proper channels. This case is dead, there is no way the ftc will be allowed to unwind this acquisition.
I only own a PS3 and this annoys the s**t outta me. The series started out on Playstation and this is how Activision behaves and gives Mircoshaft a timed exclusive. If anyone should have the timed exclusive on this it's Sony

I feel a bit shitty about the whole thing too. I was actually surprised MS put tony hawk in the summer of arcade. Especially when the have games like spelunky waiting in the wings.

Oh,M$ you and your timed DLC,games etc.Won't make me buy this on your platform i still have my original copy that still has split screen one of the things that made buy this game.Both you and Activision can stick this game where the sun don't shine.
