At least you don't need gold to get the marketplace, however i'm not sure if you need to be gold or not for community games..

$5 is next to nothing anyway, I'm surprised Microsoft didn't give this out for free.

It's in their interest that it's in the hands of as many gamers as possible, in order to create the largest amount of content.
