Microsoft, Bungie sued over Halo 3

TGDaily: A court case started in a California district court alleging that popular game Halo 3 doesn't work with the Xbox 360.

The class action, filed by Randy Nunez and others, alleges that Microsoft and Bungie made Halo 3 and stated that it was compatible with the Xbox 360, but that it wasn't.

i'm pretty sure halo 3 has nothing to do with this. it's just the 360's hardware.

I don't see any logic in the fact halo crashes Xboxes, otherwise we would have known back 2 years ago.

we need more of these so MS could start fixing their sh!t. Cant you see?,It doesn't matter if it isn't the game thats crashing, as long as they see customers trying to take advantage of their hardware reliability, MS will hopefully say " f@ck not another lawsuit, TIME TO FIX THE DAMN THING". Its the consumers against the Money thirsty Companies, YOU'RE EITHER WITH US OR AGAINST US!!!!!!!!!

1.6 - huh I dont get it
they shoulda sued over the 360s crappy hardware not working properly, not halo 3 not being a 360 game. Halo 3 is a 360 game regardless if you 360 works or not. these guys dont have a chance if they are trying to prove its not made to be a 360 game.

I played halo 3 on my 360 and so have millions of others.

edit- wouldnt it just take microsoft hooking up a 360 and playing halo 3 on it to prove this is wrong? Even if the console got rrod, this is about halo 3 not being a 360 game(when it clearly is. there are probably about 100,000 people online right now), not 360 being crap hardware.

"Best'a luck"...are you kidding me? You do realize if they win or settle out of court it will give other people reasons to sue if their game crashes on them? Should PC gamers begin to sue developers when their games crash or barely run as advertised even if they meet the specifications?

This could be anyone, be it Sony, Nintendo, Sega, Atari, etc, it would be a huge blow to gaming and simply open the flood gates. Millions of copies and systems beg to differ with these claims.

I have no issue with customer complaint or lawsuits, but the country is going down the drain because the lawyers tax is affecting us all. Did you know there are more lawyers in California then the rest of the US?

Only way to stop this is, looser pays the fees. You ain't fishing if attempting to catch a fish might cost you.

Dude i'm not whining...but this crap has gone far enough. Why would i want to be labeled as a dumb american when i'm not?? While it may be true that we have stupid people, i am not one of them, so why would it be fair to put that kind of generalization on those who aren't idiots?....same thing goes when other people say americans are fat and lazy...do you really want to be prejudged and "labeled" like that?

And same thing goes for all countries and nationalities

I could swear I'd played through Halo 3, but now I guess it was aaaaaaall a dreeeeeeeam.

And by the way, did the guy trying looking at the surface of the disc to see if it was covered in scratches? That tends to be the thing to make games randomly lock up or crash...Though I'm not preparing any class action lawsuit against Microsoft because my copy of Crackdown was accidentally put face-down on a table that had sand on it and moved around a bit with other games stacked on it, resulting in some mildly awesome-looking swirly scratches all over it (aren't friends awesome?!).

I should get the surface fixed though - it's been sitting on my shelf for about a year now unplayable (gets to the menu screen with the city in the background and then freezes once the city rotates to a certain angle).

they are sueing MS because they are selling Halo3 to the customers with the systems that won't let them play the game when they bring the game home. they are not sueing Halo 3 the game itself. they are sueing the company for the act of selling the game and how they have breached the commitment. its just like you go to a supermarket and buy something you want to eat, when you go home, you find out that you cannot eat it because its all rotten inside the box, get it?

Haha, geez u take things a little too seriously. You must be young. Why would I get mad if someone called me a fat American, knowing full well that I'm in shape? Why would I care if someone called me dumb even though I have a college degree? Those have to be thee most childish insults ever.

I'm black, I've dealt with my fair share of racism and prejudice growing up in predominantly white neighborhoods. So yeah, if someone dropped the N-Bomb on me, I'd sure as hell take offense. But if someone calls me dumb or fat and expect me to be legitimately angry about it?? lol yea right... That's elementary school stuff.

I still don't know what you're hellbent on though. Kigmal never even said anything about dumb Americans. He said

"Americans doing all they can these days to stay alive with our economy. What a dumb lawsuit. "

Maybe it's a slight case of dyslexia that's troubling you but I didn't see him call American's (as a whole) dumb, stupid or fat (And obviously not too many others took the way you did, judging by the number of his agrees vs his disagrees).

Now I said we definitely have some dumb people here in the states (more so joking around) but either way, if you disagree with that statement, you'd be dumb as well because to think the US is ONLY full of incredibly smart high level IQ folks, is just downright ignorant. To think that about any country is downright ignorant...

But back to me original point: Stop whinning and brush it off (even though there was never really anything harmful said to brush off... Which is why I'm still confused...)

And yes, this IS a dumb lawsuit. Surely we're in agreeance on that?!

1.21 - ^^ @ NoBias
I think he may be on the defensive simply because there is a LOT of anti-American sentiment on the net from other countries that seem to make vastly swift generalizations and blanket statements when they even hear the word American. Yes, Kigmal didn't directly state anything "anti-American" but this site has been flushed with those sentiments in the past, and perhaps he's a bit edgy about it, I know I am. I get disgusted reading about how I'm inherently inferior because of the location I was born in, what the hell did I do? Dumb? Fat? I'm smart and am into bodybuilding, and I try to be a sincere and just person, so how is my country of origin suddenly dictating anything to the contrary? I don't know, and that's why some of us get on edge about possible mud-slinging.

I get tired of seeing myself lumped in because some idiot in another state did or said something ignorant. No, it's not relevant to me nor is it affecting me directly, but just like you have your own offensive reactions to slurs, many of us here don't like the level of outrageous stereotyping present on the internet or in real life, anti-American statements are a slur to me. It's a sad fact that there's many ignorant people in any country, but it doesn't matter which one you're speaking of, generalizing ONLY off of nationality is just flat-out stupid and pointless, not to mention blatantly inaccurate. Maybe you don't see so much of this hatred (or maybe you don't care), but some of us have and some of us would like the record set straight.

What you expect from a company like MS? They spend too much time trying to copy others rather than fixing their own hardware denying theres a fault. It's the only way they can keep up with Sony and Nintendo if they admitted fault with as many Xbox's that have really died it would be the end of the 360 so instead they take it on the chin and hope the problem will go away.

I agree with you as well. It is stupid but if anything it just makes the fools lumping us into a "stupid" category look stupid ha. If they think all of America are idiots then it just proves they're the uneducated and ignorant ones.

"Maybe you don't see so much of this hatred (or maybe you don't care), but some of us have and some of us would like the record set straight."

Haha, get in line ;) We still have to eliminate racism, religionism and sexism waaayyyyyyyyyyyyyyy before we can think about setting the record straight about us being stupid as a collective whole (Ya gotta see the irony in that!).

The level of importance between those is night and day. Those who have dealt with racism, religionism and/or sexism will be the first to tell you that.

Too many other immediate important issues ahead of that :\

Just proves the ignorance and stupidity of some people here. I don't even know why I'm trying to have an educational conversation on this site. Especially about certain things that a lot of you will never even experience (and you're very luck not to). I'll stick only to gaming talk here as a lot of you aren't mature enough to handle a conversation like this. The open zone proves that...

Things will never change. And if they do, sadly it won't be anytime soon...

1.25 - Well
I actually didn't intend to prioritize any of those persecutions, they're all wrong. What I meant by what you quoted was that maybe you don't see all the anti-American hatred, I wasn't referring to you not seeing racism or sexism. I've experienced a whole lot of reverse discrimination regarding gender at my old place of employment. It was NOT a two way street for males there, and it sickened me, as the females got special treatment from management, as it was a laborious job. It all needs to be fixed, and it's all wrong, I didn't mean to infer one form was worse than another, none of it's right and needs to stop.

Do it game by game. The fact is they shouldn't make games for it if it can't run right. Every publisher and developer the first 3 years of the life of this console is going to have a price to pay for faulty products.

The filing says:

"Defendants knew or had reason to know that Halo 3 was being purchased by consumers for use on an Xbox 360 and that the buyers of Halo 3 were relying on Defendants' skill and judgment to furnish goods suitable for that purpose.

However, Halo 3 does not function with the Xbox 360, and to the contrary, attempted use of Halo 3 consistently causes the Xbox 360 to 'crash,' 'freeze' or 'lock up' while the game is being played."

I've never have my 360 crash, freeze or lock up playing Halo 3. Has anyone ever have those things happen playing Halo 3

It's far more likely for a 360 to RRoD or fail before Halo 3 fails. Afterall Halo 3 is softwere which I highly doubt pushes the 360 to the limit compared to titles such as Gears of War to etc.

It'd be pretty funny if Microsoft had to recall EVERY copy of Halo 3, all 10 million of 'em. The cost and embarasment would be pretty high, but I HIGHLY doubt that'll ever happen. Afterall Microsoft got away with RRoD, E74, Update failures and Video failures.
